Terms of Service

FleetKraft is a transport management service: the web app at fleetkraft.com and the FleetKraft driver app for Android and iPhone. It is provided by 1Shopindia, a sole proprietorship in India ("we", "us").

These terms are an agreement between us and the business that signs up ("you", the "company"). The person who signs up confirms that they may accept them for the company. By creating an account or using FleetKraft you accept these terms, our Privacy Policy and our Cancellation and Refund Policy.

FleetKraft is for businesses, not for personal or household use.

• You give correct details when you sign up and keep them up to date, including your business number and billing email.
• Admins of your company invite staff, drivers and customer portal users and choose their roles. You are responsible for what your users do in FleetKraft.
• Keep passwords safe and tell us straight away at the email below if you think someone has used your account without permission.

New companies get a free trial, normally 30 days; the Billing page shows the end date. We may give a longer trial. During the trial every feature works and nothing is charged. When the trial ends without a payment, FleetKraft becomes read-only until you pay.

• One plan with every feature, charged per company per month in your country's currency (AUD 399, USD 299, CAD 399, INR 29,999 + GST). The current price is on our Pricing page and your Billing page.
• Companies in India pay 18% GST on top. Companies outside India pay no GST or sales tax to us, because FleetKraft is supplied from India (export of service); any tax due in their own country is theirs to account for.
• Each payment includes a card processing fee of 3.54% of the payment (2.36% in India), with nothing further added to it outside India. In India, GST is charged on the price and the fee. The Billing page shows the amount charged each month.
• You pay ahead for 1, 3, 6 or 12 months at a time on your Billing page, as a one-time payment through our payment provider (Razorpay). There is no autopay: nothing is charged automatically. A payment made during the free trial starts when the trial ends; a payment made during a paid period starts when that period ends.
• A discount or discount code applies to the number of months it states, on the next months you pay for; further months are at the normal price. The amount is shown before you pay.
• We remind your Admins and Accounts team in the last 5 days before the trial or the paid period ends. If it is not renewed, your account becomes read-only until payment is made; your data is kept as set out in section 6.
• We may change the price. We will email your Admins at least 30 days before a new price applies to you. A new price never changes time you have already paid for.

There is nothing to cancel: if you do not renew, the time you paid for runs to its end and nothing further is charged. Payments are not refunded except as set out in our Cancellation and Refund Policy.

• The information you and your users put into FleetKraft (jobs, customers, drivers, photos, pay records and so on) belongs to you. You let us store and process it to provide the service, as described in our Privacy Policy.
• You are responsible for having the right to collect it and for telling your drivers, staff and customers how it is used, including on-duty location sharing and the clock-in and delivery photos your company asks for, and for any consent the law requires.
• After your trial or paid period ends your data stays available read-only for 6 months and is then deleted, unless the law requires us to keep part of it longer.

FleetKraft calculates pay, tax withholding, superannuation and similar amounts, and creates payslips, bank files and invoices, from the rates, rules and tax tables you set or choose. These are tools to help you; they are not tax, legal or accounting advice. You remain responsible for checking the results, paying your workers and suppliers correctly, and meeting your tax, payroll and reporting obligations.

You agree not to:

• use FleetKraft for anything unlawful, or to store or send content you have no right to;
• track people outside the purposes FleetKraft is made for, or without the notice and consent the law requires;
• try to get into other companies’ data, test or break our security, or overload the service;
• copy, resell or rebuild FleetKraft, or remove our notices.

• We aim to keep FleetKraft available at all times, but there may be interruptions for maintenance or for reasons outside our control. We do not promise that it will be uninterrupted or free of errors.
• We keep improving FleetKraft and may add, change or remove features. We will not remove a main feature you rely on without telling you first.
• Some parts depend on other services, such as maps, email delivery, payment providers and the app stores. Their own terms apply to them and we are not responsible for them.
• Support is by email and chat.

FleetKraft, its software, design and brand belong to 1Shopindia. While your subscription (or trial) is active you may use it for your business under these terms. Feedback you send us may be used to improve FleetKraft.

• FleetKraft is provided "as is". To the extent the law allows, we give no promises beyond those in these terms.
• We are not liable for indirect or consequential loss, such as lost profits, lost business or lost data that could have been kept by exporting it.
• Our total liability to you for any claim is limited to the subscription fees you paid us in the 12 months before the claim.
• Nothing in these terms limits rights you have under consumer or other laws that cannot be excluded.

We may suspend or close an account that breaks these terms, is used unlawfully or puts the service or other customers at risk, normally after warning you. You may end the agreement at any time by not renewing, or by emailing us.

We may update these terms. We will post the new version here with its date and email your Admins about important changes. Continuing to use FleetKraft after a change means you accept it.

These terms are governed by the laws of India. Please contact us first so we can try to solve any problem. Disputes are decided by the courts at Himmatnagar, Gujarat, India.
